British Airways was delighted to learn that on January 26, 1998, United States District Court Judge Wilkie D Ferguson, Jr reinstated his previous order dismissing Laker Airways` complaint against British Airways in the US District Court in the Southern District of Florida.

Judge Ferguson had previously dismissed Lakers` case by order on November 26, 1997 finding that the US carrier`s suffered from both a “procedural and substantive defect.”

On December 12, 1997, following Lakers` motion for reconsideration, Judge Ferguson temporarily vacated his Order of Dismissal pending further briefing by the parties.

Having considered the briefs submitted by the parties, Judge Ferguson again dismissed Laker`s complaint.
